PPWR Article 45: Extended producer responsibility

What it requires

Producers carry extended producer responsibility for packaging they make available for the first time on a member state territory, or that they unpack without being end users. Financial contributions cover the Directive 2008/98/EC cost base plus the cost of labeling waste receptacles under Art. 13 and the cost of the data-gathering and reporting exercises. Art. 45(1) is also one half of the legal basis for grade-based eco-modulation, alongside Art. 6(4)(d). Art. 45(3) is the authorized representative requirement for producers established outside the member state of sale.
