Sets two conditions for any environmental claim about a packaging property this Regulation sets requirements for, such as recyclability (Art. 6), recycled content in plastic packaging (Art. 7), compostability (Art. 9) or reusability (Art. 11). Under point (a), the claim may relate only to a property that exceeds the applicable minimum requirement, measured with the criteria, methodologies and calculation rules the Regulation sets out. Under point (b), the claim must say whether it covers the packaging unit, part of the unit, or all packaging the economic operator places on the market. Compliance with both conditions is demonstrated in the Annex VII technical documentation for the packaging. The article carries no date of its own, so it applies from August 12, 2026 under Art. 71. It takes the meaning of environmental claim from Article 2, point (o), of Directive 2005/29/EC (the Unfair Commercial Practices Directive). A claim about a property the Regulation sets no requirement for falls outside Article 14. Article 2, point (o), was inserted into Directive 2005/29/EC by Directive (EU) 2024/825, the directive on empowering consumers for the green transition, which Member States must apply through national law from September 27, 2026. Labels and marks likely to mislead on matters with harmonized labeling are a separate restriction under Art. 12(8).
