How Regulation (EU) 2025/40 (PPWR) applies in Spain: the national extended producer responsibility (EPR) scheme, small-producer thresholds, eco-modulation, and deposit return system status. PPWR is directly applicable in Spain from August 12, 2026.

National scheme, running ahead of the harmonized duty: since 2026 Ecoembes has modulated its own fees on technical criteria set by RD 1055/2022, designed to anticipate the PPWR. Harmonized PPWR eco-modulation does not bind until around mid-2031 (Art. 6(8)), so the 2026 date is Spanish, not European. Ecoembes has already published its 2027 Punto Verde schedule, unusually early: PET beverage bottles up to 3L at 0.278 EUR/kg, PET trays and other rigid at 0.682, rigid HDPE at 0.282, other rigid plastics at 0.773, flexible film at 1.269, paper and cardboard at 0.117, beverage cartons at 0.544, steel at 0.197, aluminum at 0.040 [LOCKED, Ecoembes 2027 price sheet]. Glass is Ecovidrio, not Ecoembes. Envalora covers industrial and commercial packaging separately.
Spain has its own DRS mandate: RD 1055/2022 requires launch by November 2026 (trigger confirmed November 2024), but operator authorization stalled at regional level through July 2026 and slippage is widely reported [SIGNALED]. No PPWR-specific national implementing measures enacted; Ley de Residuos 7/2022 remains the baseline national packaging law.
